Holiday obstacles
If you have been prevented from taking your holiday during the holiday entitlement period due to a holiday obstacle, special rules apply, which you can read more about below.
What is a holiday obstacle?
Before we review the holiday obstacle rules, we need to take a closer look at what a holiday obstacle actually is:
A holiday obstacle can arise in several situations. The most common are:
- Own long-term illness
- Maternity/paternity, parental and/or adoption leave
- Stays abroad, if you are not in an employment relationship covered by the Danish Holiday Act during the stay
- Leave to care for sick or dying close relatives
Accrued holiday up to four weeks
If you have not been able to take all or part of your holiday during the holiday entitlement period due to a holiday obstacle the 31 December, up to four weeks of holiday with pay will be transferred to the next holiday entitlement period. It is not possible to have the value of accrued days of holiday disbursed. It is necessarily that the obstacle still applies 31 December.
If your holiday obstacle continues until the end of the next holiday entitlement period, the holiday will again be transferred unless the holiday obstacle consists of illness or maternity/paternity, parental and/or adoption leave. Please note that you must take your holiday in the subsequent holiday entitlement period, as we are obliged as an employer to ensure that you take minimum four weeks of holiday per holiday year. The scheduling of your holiday must be agreed with your immediate manager.
Accrued holiday in excess of four weeks
If you have had a holiday obstacle and have therefore not been able to take your holiday (less than 4 weeks), your accrued holiday in excess of four weeks will be disbursed after the end of the holiday entitlement period (31 December). However, you can agree with your manager that accrued holiday in excess of four weeks will be transferred to the next holiday entitlement period.
Holiday obstruction due to illness or parental leave
In a situation in which you have not been able to take your holiday due to illness or maternity/paternity, parental and/or adoption leave and where four weeks of holiday have been transferred to the next holiday entitlement period, the transferred holiday may be disbursed, provided that the holiday obstacle persists to the end of the next holiday entitlement period.
