Becoming a parent in a LGBT+ family

Deadlines and Requirements for Legal Parents

  • If you are pregnant, you must inform your manager and Corporate HR no later than 3 months before the expected birth.
  • If you are a father/co-mother, you must inform your manager and Corporate HR no later than  weeks before the parental leave begins.
  • No later than 6 weeks after the child is born, you must complete this form and upload it to DTU Fusion.

Legal Parent in an LGBT+ Family

As a legal parent in an LGBT+ family, you have the option to transfer the non-earmarked part of your parental leave to up to two social parents. This means that an LGBT+ family can potentially share parental leave between four parents: two legal parents and two social parents. A social parent can only be granted transferred leave if the legal parent wishes to do so.

Leave as a Social Parent

A social parent is a person intended to have a parent-like relationship with the child. A social parent can be your spouse or partner (with at least 2 years of cohabitation) or the spouse/partner (2 years of cohabitation) of a known donor.

As a social parent, you are entitled to take the leave transferred to you by a legal parent. The leave is unpaid and must be taken before the child turns 1 year old. If you are entitled to parental benefits, you can apply for them at Borger.dk and learn more about it at Lifeindenmark.dk.

Deadlines and Requirements for Social Parents

No later than 6 weeks after the child is born, you must complete this form and upload it to DTU Fusion.

Both legal and social parents must meet the applicable employment and notification requirements under the Parental Leave Act. This means that you must be employed or a member of an unemployment insurance fund (a-kasse) and have notified your employer according to the applicable deadlines before you are entitled to receive parental benefits during your leave. You can also read more about your rights as a social parent at Lifeindenmark.dk.
